LIMITATION OF LIABILITY UNDER NO CIRCUMSTANCES SHALL CREATIVITY INCLUDED BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE, EVEN IF CREATIVITY INCLUDED OR AN AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.

2. License All of our theme packages are released under the GNU Public License version 2.0.

Any PSD files are packaged separately and are not licensed under the GPL 2.0. Instead, these files inherit the Creativity Included Personal Use License. These files are provided on a personal use basis. You may not offer them, modified or unmodified, for redistribution or resale of any kind.

3. Ownership and Liability You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of Creativity Included. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

4. Refund Policy Due to the digital nature of our products, we do not offer refunds. However, StudioPress, the distributor of the Family Tree and Bee Crafty Genesis child themes, does offer a 30 day window in which to request a refund. If you would like to inquire about a refund on either of those themes, please contact StudioPress.

5. Warranty Our products are provided “as is” without warranty of any kind, either expressed or implied. We do not guarantee that themes will work in all browsers, nor do we guarantee that our themes will be functional with all versions of WordPress. We do not guarantee compatibility with any additional third party plugins, scripts, or applications.

7. Photo and Illustration Copyright Info When viewing theme demos you will see several photographic and illustrative images used. These images serve as example images only and are not included with the theme. Our themes do not come packaged with any copyrighted photography or illustration unless otherwise specified. The images used in the demos are purely for demonstration purposes, and are used to give the visitor a functional preview of what the theme will look like once content has been added. You are responsible for adding your own thumbnail images. The photos used in our demos are licensed from http://www.istockphoto.com/, and are Copyright iStockphoto LLC. These photos should not be saved, copied or redistributed in any way.
